Scope

This privacy policy informs users about the nature, scope, and purposes of the collection and use of personal data by the responsible provider "The Makery", J. Kolb, John-Schehr-Str. 2, 10407 Berlin, on this website (hereinafter referred to as "offer").

The legal foundations of data protection can be found in the Federal Data Protection Act (BDSG) and the Teleservices Act (TMG).

Handling personal data

Personal data is information that can identify an individual, meaning details that can be traced back to a person. This includes the name, email address, or phone number. But it also encompasses data about preferences, hobbies, memberships, or which websites someone has visited, all of which qualify as personal data. Personal data is only collected, used, and shared by the provider when legally permitted or when users consent to the data collection.

Access data / server log files

The provider (or its web space provider) collects data about each access to the offer (so-called server log files). The access data includes: name of the retrieved website, file, date and time of retrieval, amount of data transmitted, notification of successful retrieval, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address, and the requesting provider. The provider uses the log data only for statistical evaluations for the purpose of operation, security, and optimization of the offer. However, the provider reserves the right to review the log data subsequently if there are concrete indications of justified suspicion of unlawful use.

Collection and processing when using the contact form

When using the contact form, we collect your personal data (name, email address, message text) only to the extent you provide it. The data processing is for the purpose of contacting you. By sending your message, you consent to the processing of the transmitted data. The processing is based on Art. 6 (1) lit. a GDPR with your consent. You can revoke your consent at any time by notifying us, without affecting the lawfulness of the processing based on consent until the revocation. We will only use your email address to process your inquiry. Your data will then be deleted, unless you have consented to further processing and use.

Customer account

When opening a customer account, we collect your personal data to the extent specified there. The processing of data serves the purpose of improving your shopping experience and simplifying the order processing. The processing is based on Article 6 (1) lit. a GDPR with your consent. You can revoke your consent at any time by notifying us, without affecting the legality of the processing that took place based on the consent until the revocation. Your customer account will then be deleted.

Collection, processing and use of personal data for orders

When placing an order, we collect and use your personal data only to the extent necessary for fulfilling and processing your order as well as for handling your inquiries. Providing the data is required for the conclusion of the contract. Failure to provide it will result in the inability to conclude a contract. The processing takes place on the basis of Article 6 (1) lit. b GDPR and is necessary for the fulfillment of a contract with you. Your data will not be passed on to third parties without your explicit consent. The only exceptions are our service partners, whom we need for the processing of the contractual relationship or service providers that we rely on within the framework of order processing. In addition to the recipients named in the respective clauses of this privacy policy, this includes, for example, recipients from the following categories: shipping service providers, payment service providers, merchandise management service providers, service providers for order processing, web hosts, IT service providers, and dropshipping merchants. In all cases, we strictly adhere to legal requirements. The scope of data transmission is limited to a minimum.

Comments and contributions

When users leave comments or other contributions, their IP addresses are stored. This is done for the provider's safety in case someone writes illegal content (insults, prohibited political propaganda, etc.) in comments and contributions. In this case, the provider can be held responsible for the comment or contribution and is therefore interested in the identity of the author.

Use of PayPal

All PayPal transactions are subject to the PayPal Privacy Policy. You can find it at https://www.paypal.com/de/webapps/mpp/ua/privacy-prev?locale.x=de_DE

Right to data portability

You have the right to request that personal data processed by us on the basis of your consent or to fulfill a contract be provided to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of data to another controller, this will only be done to the extent that it is technically feasible.

Right to information

You have the right to request confirmation from us as to whether your personal data is being processed, as well as, if applicable, to obtain information about this personal data and the other information listed in Article 15 of the GDPR.

Rights of the affected person

You have the following rights under Articles 15 to 20 of the GDPR, provided that the legal requirements are met: the right to access, to rectification, to erasure, to restriction of processing, and to data portability. Furthermore, you have the right to object under Article 21 (1) of the GDPR against processing based on Article 6 (1) (f) of the GDPR, as well as against processing for direct marketing purposes. Please contact us if you wish. You can find the contact details in our imprint.

Right to deletion (“Right to be forgotten”)

You have the right to request the immediate deletion of your personal data from us, provided that one of the reasons specified in Article 17(1) of the GDPR applies, and the processing is not necessary for one of the purposes regulated in Article 17(3) of the GDPR.

Right of withdrawal upon consent

As far as the processing is based on your consent, you have the right to withdraw your consent at any time. The legality of the processing carried out on the basis of the consent until the withdrawal is not affected.

Encrypted payment transactions on this website

If, after entering into a paid contract, you are required to provide us with your payment details (e.g., account number for direct debit authorization), this information is needed for processing payments. Transactions using common payment methods (Visa/MasterCard, direct debit) are conducted exclusively over an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address bar of your browser changes from "http://" to "https://" and by the padlock symbol in your browser's address bar. With encrypted communication, your payment details that you send to us cannot be read by third parties.

SSL or TLS encryption

This page uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operators. You can recognize an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the padlock symbol in your browser bar. When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

We inform you about us and our offers through our newsletter. If you would like to receive this, we need a valid email address from you, as well as information that allows us to verify that you are the owner of the provided email address or that the owner agrees to receive the newsletter. No additional data will be collected. This data will only be used to send the newsletters and will not be shared with third parties. By subscribing to the newsletter, we will store your IP address and the date of registration. This storage is solely for the purpose of providing proof in the event that a third party abuses an email address and registers for the newsletter without the knowledge of the rightful owner. You can revoke your consent to the storage of the data, the email address, and its use for sending the newsletter at any time. The revocation can be done via a link in the newsletters themselves, in your profile area, or by notifying us using the contact options provided above.

Integration of third-party services and content

It may happen that within this online offering, third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds, or graphics from other websites, is embedded. This always requires that the providers of this content (hereinafter referred to as “third-party providers”) perceive the users' IP address. Because without the IP address, they could not send the content to the user's browser. The IP address is therefore necessary for the display of this content. We strive to use only those contents whose respective providers use the IP address solely for delivering the content. However, we have no influence if the third-party providers store the IP address, for example, for statistical purposes. As far as we are aware, we inform the users about this.

Use of Facebook Social Plugins

This offer uses social plugins ("plugins") from the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). The plugins can be recognized by one of the Facebook logos (a white "f" on a blue tile, the terms "Like," "Gefällt mir," or a thumbs-up sign) or are marked with the addition "Facebook Social Plugin." The list and appearance of the Facebook Social Plugins can be viewed here: https://developers.facebook.com/docs/plugins. When a user visits a webpage of this offer that contains such a plugin, their browser establishes a direct connection with Facebook's servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website. Therefore, the provider has no influence on the scope of the data that Facebook collects using this plugin and informs users accordingly based on their knowledge: By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the offer. If the user is logged into Facebook, Facebook can associate the visit with their Facebook account. When users interact with the plugins, for example, by clicking the Like button or leaving a comment, the corresponding information is transmitted directly from your browser to Facebook and stored there. If a user is not a member of Facebook, there is still a possibility that Facebook learns and stores their IP address. According to Facebook, only an anonymized IP address is stored in Germany. The data processing is based on your consent (Art. 6 Para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The lawfulness of data processing operations that have already taken place remains unaffected by the revocation. The data you provided for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from MailChimp's servers after the newsletter has been unsubscribed.
